Who is responsible for the processing of your personal data?

From whom or where do we obtain your personal data?
We process personal data that you have shared with us.

Who can access your personal data?
Your personal data is primarily processed by us at Babaam. We will never sell your personal data. In some cases, we share your personal data in order to fulfill our obligations to you in an efficient and effective manner:

  • To ensure that you pay us, our payment solution providers will have access to your personal data.
  • In order for us to deliver your products to your home address or delivery location and to handle returns, we will share your personal data with shipping companies.

Do we transfer your personal data outside the EU/EEA?
Babaam generally processes your personal data within the EU/EEA, but in individual cases we use suppliers from countries outside the EU/EEA. When we transfer your personal data outside the EU/EEA, Babaam ensures that there is an adequate level of protection. Babaam may transfer your personal data to the USA, to our newsletter provider and to our suppliers who provide services to market relevant products and to make our website as relevant as possible. Please contact us if you have any questions about how we share your personal data.

How can you influence the processing of your personal data?
Under data protection laws, you have several rights to influence our processing of your personal data. Read more below.

Right to withdraw consent and object to processing

You have the right to withdraw your consent to the processing of your personal data in whole or in part. Your withdrawal will be effective from the time you withdraw your consent. You have the right to object to the processing of your personal data. You always have the right to object to marketing from us, such as newsletters. You generally have the right to object when the processing is based on a balancing of interests. Read more about what this means below. In some other cases, the right to object does not exist (e.g. because we must store your personal data). If we can demonstrate compelling legal grounds for the processing that outweigh your interests and fundamental rights or if it is for the purpose of determining, exercising or defending legal claims, you never have the right to object to the processing.

Right of access

You have the right to obtain confirmation as to whether we are processing personal data concerning you. You may access the personal data and obtain a copy of the personal data we are processing.

Right to rectification
You have the right to have incorrect personal data concerning you corrected and to ask us to have incomplete personal data completed.

Right to erasure (“right to be forgotten”) and restriction of processing
Under certain circumstances, you have the right to have your personal data erased. This applies, for example, if the personal data is no longer necessary for the purpose for which it was collected or processed or when you withdraw your consent on which the processing is based and where there is no other legal basis for continuing the processing. You also have the right to request that Babaam restrict the processing of your personal data. This applies, for example, when the accuracy of the personal data is contested by you or if the processing is unlawful and you oppose the erasure of the personal data and instead request that its use be restricted.

Right to lodge a complaint with a supervisory authority
You always have the right to lodge a complaint with a supervisory authority. You can do this in the specific EU/EEA Member State where you are resident, where you work or where an alleged breach of applicable data protection law has occurred. In Sweden, the supervisory authority is the Swedish Data Protection Authority. This right does not affect other administrative or judicial measures.

Right to data portability
You have the right to ask us to transfer some of your personal data that we hold about you to another company (data portability). This right applies to personal data you have provided to us in a structured, commonly used, machine-readable and compatible format if:

  • The processing is based on consent or a contract; and
  • The processing is performed automatically

When exercising your right to data portability, you have the right, where technically feasible, to have personal data transferred directly from Babaam to another data controller.

How and why do we process your personal data?
Our goal is to be as transparent as possible about how and why we process your personal data. In the table you can read more detailed information about why we process your personal data (the purposes of the processing), what personal data we process, our legal basis for processing your personal data and how long we process your personal data for each purpose.

Treatment before purchase
In order for us to communicate with you and to receive feedback from you, we must process your personal data. If you do not provide us with your personal data for these purposes, we will not be able to provide you with the service or answer your questions.

Processing necessary for the implementation of purchases and contracts, etc.
In order for us to be able to complete your purchase, for example to deliver the product, we need to process your personal data. We also need to process your personal data to comply with legal regulations or other requirements, such as the Accounting Act's requirement to save data and consumer protection laws. If you do not provide us with personal data for these purposes, we will not be able to complete your purchase with us. Please note that our payment solution providers also process your personal data to administer the payment for your order. Our payment solution providers are independently responsible for such processing. Some of our payment solution providers allow you to choose an easier way to complete purchases by automatically filling in your personal data or being remembered on your device.

We do not guarantee that the images reflect the exact appearance of the products as a certain color difference may occur depending on the monitor, photo quality and resolution. Complaint

We follow the Swedish Consumer Agency's recommendations for e-commerce. Customer service must always be contacted via our contact form, email (babaam.se@gmail.com) within a reasonable time. For more information, see below. Complaints must be made via our contact form. Complaints about broken products must be made within a reasonable time after the defect has been discovered, but no later than 1 year from the time of purchase. Please note that the broken product and packaging must be saved until the matter is resolved. If the item is not in stock or has been discontinued, we will contact you before further processing. We normally handle complaints within 3-14 working days. If a complaint about a purchase is approved, we will refund the amount for your order within 30 days.

Exceptions to the right of withdrawal
The product must be unopened and unused, but by law you have the right to ensure its properties and functions. When exercising the right of withdrawal, we have the right to make a depreciation deduction in cases where the product has been handled to a greater extent than necessary. Depreciation is assessed on a case-by-case basis. Opened and/or used makeup products are not taken back due to health and hygiene reasons. If the cancellation of the purchase is approved, we will refund the amount for your order within 21 days.

Right of withdrawal
When purchasing products on Babaam.se, you as a customer have a 30-day right of withdrawal from the date you have received the goods you have ordered. You are responsible for checking that the delivery and the products are undamaged upon receipt of the package.

You have 30 days of open purchase from the date you receive the package, provided that the product is returned unused in undamaged original packaging and in cases where the product is sealed, this must be unbroken. You can then choose whether you want to exchange for another product or get your money back. If you wish to make an exchange, contact our customer service before sending in a return. In the event of a return or exchange, you will pay the return cost yourself.

If you would like a standard form for exercising the right of withdrawal, it is available on the Swedish Consumer Agency's website, www.konsumentverket.se
Returns processing takes approximately 1-3 weeks. Remember to save the receipt for your return and send it with tracking so that we can reimburse you for the return even if the package is lost during delivery.
